What can be expected from a DUI in court? This can vary greatly. For first time DUIs, we can often get an offer for a plea bargain that is acceptable to the client, and it can be over fairly quickly after the client accepts the offer. On the other hand, some of the more serious DUI cases can get quite involved. In more serious cases, it becomes difficult to get a reasonable plea bargain offer, and the only possibility for a better outcome is to go to trial.

If a case is set for trial, it can take many more court dates and much more time before the case is over. When a case gets set for trial, we also get set a date for a motions hearing where we argue for things like suppression of evidence. If the case involves scientific evidence, we may need to call in a scientific expert to testify in your case. Even after the trial is over, you may be faced with a month or more before you're truly finished. You may have to get a pretrial sentencing report and then come back again for sentencing.

What is needed for early reinstatement after being convicted of DUI? When you're convicted of a DUI, the Division of Motor Vehicles will revoke your license, but they will allow you to reinstate early. If you decide to reinstate early, you'll be given a restricted license that will require that any car that you drive have an interlock device. The interlock device is basically a breathalyzer that gets installed in your car so that you basically have to prove that you haven't been drinking in order to drive your car.

If you've been drinking and you blow in the interlock device, the car won't start. In order to get the restricted license, you'll have to wait 30 days before losing your license if you consented to a chemical test, or 60 days if you refused a chemical test. You'll also need to get SR-22 insurance from your agent. You'll need to get an interlock device installed in your car, start alcohol classes, and pay the reinstatement fee.

Should you agree to a chemical test? This is a tough question to answer. The reason it's a tough question to answer is because you stand to lose your license for a slightly longer period of time if you refuse. If you refuse a test, you have to wait a period of sixty days before you can get a restricted license that will allow you to get back on the road. While if you agree to a chemical test, you'll only have to wait thirty days before you're allowed to get your restricted license.

In addition, you'll also be without a regular driver's license for a lot longer. That said, you improve your chance of beating a DUI in court if you don't agree to a chemical test. If you've been drinking, a chemical test will likely reflect that you've been drinking. So by agreeing to a chemical test, you're essentially helping the government to convict you of DUI. You're giving them more evidence than they might have otherwise.

It's not your job to help the prosecution get a conviction. So my opinion is that you're better off refusing a chemical test.
